Pinnacle Online Marketing Terms of Service for SoloForce

By checking the box and/or digitally signing this agreement, you acknowledge that you have read, understood, and agree to the following Terms of Service (“Terms”) between Pinnacle Online Marketing Pty Ltd (“Pinnacle,” “we,” “us,” or “our”) and you, the client (“User”).
These Terms govern your access to and use of the Pinnacle SoloForce software platform and related coaching, support, and marketing services (“Services”).
1. Service Overview
Pinnacle SoloForce is a “done-with-you” lead-generation and automation system. We provide access to our software, onboarding, support, and advisory coaching designed to help you implement your marketing and sales systems effectively. All coaching is advisory only—implementation and results depend on your own actions, market, and ad spend.
2. Minimum Term Commitment
Your initial agreement term is a fixed 120-day (four-month) minimum commitment.
After the 120-day period, the subscription automatically converts to month-to-month unless canceled in accordance with Section 6.
If you choose to cancel before the end of the 120-day period, all remaining payments for that period become immediately due and payable.
3. Payment Terms
Subscription fees are billed monthly to the active payment method on file.
You authorize Pinnacle Online Marketing Pty Ltd to automatically charge your card each billing cycle until written cancellation is received and confirmed.
A one-time setup fee is payable upon sign-up and remains due regardless of early cancellation.
All payments are final and non-refundable once processed.
4. Overdue Accounts & Debt Collection
If your account remains unpaid for more than 45 days with no correspondence, the balance may be forwarded to an independent debt-collection agency without further notice.
You remain liable for all outstanding balances, regardless of any chargeback outcome or third-party payment dispute.
Any chargeback or reversal of payment will be treated as a breach of contract, and your account may be suspended or terminated immediately.
5. Communication Credits (Twilio Usage)
Each monthly payment includes a $30 communication credit, applied toward texts, calls, and emails.
Approximately 1,515 texts (60 characters each), 1,408 minutes of calls, or 28,571 emails.
When the credit is exhausted, an automatic $10 top-up will be billed to your card on file.
Unused credits roll over month to month.
Communication rates, credits, and pricing are subject to change without notice based on carrier and platform costs.
6. Cancellation Policy
Cancellations must be submitted in writing at least 7 days prior to your next scheduled billing date.
Cancellations made after this window may result in one additional billing cycle being charged.
Access to the platform will remain active until the end of the current paid period.
7. Ownership, Access & Intellectual Property
All datayouinput into your account remains your property.
All software systems, automations, workflows, funnels, domains, templates, and materials provided by Pinnacle remain theexclusivepropertyofPinnacleOnlineMarketingPtyLtd.
Strictly one (1) user per account is permitted unless prior written authorization is granted by Pinnacle management. Shared logins, sublicensing, or multi-user access under a single account is prohibited and may result in suspension or termination.
You agree not to copy, redistribute, resell, or share any proprietary components, templates, or automations.
8. Platform Dependencies
Pinnacle SoloForce operates on infrastructure provided by integrated third-party services such as Twilio Mailgun, ChatGPT and others. By using the platform, you acknowledge that your use is also subject to the applicable third-party terms. Pinnacle is not responsible for downtime, performance issues, or losses arising from third-party providers.
9. Results Disclaimer
Selling an additional 10 cars per month is typical based on client data but not guaranteed. Results depend entirely on how the system is implemented, your market conditions, effort, and ad spend. Pinnacle makes no guarantee of income, profit, or sales performance.
10. Termination
Pinnacle reserves the right to suspendorterminate your access for non-payment, misuse, shared-account access, or breach of these Terms. Termination does not relieve you of any outstanding payment obligations.
11. Acceptance & Authorization
By checking the acceptance box and/or digitally signing this agreement, you:
Confirm that you have read, understood, and agree to all terms herein.
Authorize Pinnacle Online Marketing Pty Ltd to charge your chosen payment method on a recurring basis.
Acknowledge that all payments are final and non-refundable.
Acknowledge that you are bound by the 120-day minimum term and cancellation process.
SMS NOTE - Individuals Based in the United States & Canada
Due to regulations accounts in the United States & Canada have to be A2P compliant.
We suggest 2 options:
We have to complete an A2P application which takes avg 72 hours (This however is out of our hands!)
SUGGESTED - Our unlimited SMS solution (no extra charge from Pinnacle). This solution bypasses the need for A2P registration. Once logged into the dashboard click 'Unlimited sms' on the 'Directory' tab.
